France's defender Lucas Hernandez warms up prior to the FIFA World Cup Qatar 2022 qualification Group D football match between Kazakhstan and France, at the Astana Arena, in Nur-Sultan, on March 28, 2021.

Bayern Munich star Lucas Hernandez has avoided a prison sentence after his appeal against breaching a restraining order was accepted by Madrid’s provincial hearings court.

The 25-year-old was given until October 28 to turn himself in for breaching a restraining order back in 2017, which was enforced against him by his partner, with whom he then went to the United States on holiday.

This breach of the law meant Hernandez had no choice but to voluntarily enter Spanish prison, so he arrived in Madrid on October 18 and lodged an appeal against the ruling. And Marca reports the defender has been successful in his appeal, meaning he will not need to serve any time in jail.

Instead, the Bayern star has been handed a €94,000 fine, which he'll be forced to pay in €400 daily instalments, while a six-month suspended prison sentence will remain in place over the next four years.

Hernandez and his girlfriend travelled to Miami despite both having a restraining order hanging over them following an incident of domestic abuse between the pair earlier in their relationship. The duo ignored the law and went on holiday, posting pictures together and noting that they even got married in Las Vegas.

While Hernandez's restraining order against his partner had not been made official at that time, her order against the France international was already in place, meaning he had broken the law.

The defender ended up in serious trouble for the offence and could have been sentenced to actual prison time for breaking the restraining order. His lawyers won their appeal against the ruling however, meaning he has escaped any severe punishment.

Hernandez has continued featuring for Bayern this season, making six appearances in the Bundesliga and playing in all three of their Champions League clashes thus far.
